Terms and Conditions of Use of the DayCover App

It is important that you read and understand the information below about this app as it summarises the terms of use of your DayCover policy.

By taking out a DayCover insurance policy you agree to download, activate and use this app to record your driving activity during each journey made with the insured vehicle.

1. START OF INSURANCE

Your policy comes into force on the date and time set out in the Particular Conditions and the Receipt; this may not coincide with the time of purchase, and the insurer reserves the right to reject claims arising during that interim period. Taking out insurance after an incident or event has already occurred is not only excluded from cover but may also constitute a legal offence. The insurer reserves the right to take any legal action in such cases.

2. LIMITATIONS OF USE

Communications between insurance companies, Tirea and the Consorcio de Compensación de Seguros follow an agreed, non-automatic procedure for uploading data to the Insured Vehicle Information File (FIVA). This does not mean the vehicle is uninsured on the stated dates, but there may be limitations for passing the MOT or receiving a fine, as it may not appear in FIVA immediately. This process can take up to 3 working days. Neither the insurer nor the broker will be responsible for fines or penalties arising from not appearing in FIVA.

3. MANDATORY USE OF THE APP WHILE DRIVING

  • The Policyholder must use the DayCover App, having it installed on a compatible mobile phone during the policy period with operating permissions enabled in order to record their driving.
  • The minimum permissions that must be enabled on the phone throughout the policy period are:
    • Access to precise location or exact location.
    • Access to Physical Activity detection.
    • Access to Phone Activity.
    • Allow Notifications.
    • Access to Battery Saver or Optimisation.
  • The driver of the insured vehicle must always carry their mobile phone with the App activated during all journeys made with the insured vehicle. At the end of each journey, the insured can select whether they were the driver or a passenger in another vehicle.
  • This App reliably and objectively measures driving behaviour, which enables a more competitive premium to be offered.
  • The App collects information on driving style and assesses it using a proprietary algorithm. This information is used to calculate an average score between 10 and 100, which is also displayed visually in 3 colours (red, amber and green) like a traffic light. This final score is what allows a more competitive premium to be offered.
  • The insured can check their score and view the details of each journey in the “Driving” section of the App.

4. MONITORING OF DRIVER HABITS BY THE DAYCOVER APP

The data collected on driving activity includes, in addition to location and information on each journey made with the insured vehicle, the following factors:

  • Speed: Measures the percentage by which the vehicle exceeds the speed limit on the road. Number of events and their severity.
  • Acceleration: Measures the increase in the vehicle’s speed, per second, expressed in km/h. Number of events and their severity.
  • Braking: Measures the decrease in the vehicle’s speed, per second, expressed in km/h. Number of events and their severity.
  • Cornering: Measures the aggressiveness of turns whenever the vehicle is travelling at more than 50 km/h. Number of events and their severity.
  • Driving distractions: Measures the number of events that occur when the user uses their mobile phone while driving, as well as the duration of those events.

Driving activity data will be used to calculate the premium, as factors that influence risk assessment.

A journey is defined as each period of continuous driving of more than 100 metres, i.e. the minimum distance covered and recorded by the DayCover App installed on the mobile device of the person identified as the Driver on the Policy. For the DayCover App to assign an initial score on the policy, at least 5 km must be accumulated from the start of the policy.

5. USER CLASSIFICATION: PREMIUM AND STANDARD

The DayCover App distinguishes between two types of users:

  • Premium: those who have subscribed to the annual App fee or obtained it free of charge through a promotion.
  • Standard: all other customers.

The advantage of being a PREMIUM user is having considerably lower premiums because the surcharge for occasional use (STANDARD user) does not apply.

Payment of the premium by credit or debit card is an essential requirement for issuing the policy. When the risk is insurable, quotations present 3 prices for each type of customer (premium or standard), corresponding to the three scoring levels (driving score):

  • GREEN: indicates that, upon policy expiry, a score corresponding to excellent driving has been achieved. This score corresponds to the best price (the cheapest and most competitive premium, in recognition of the driving style demonstrated).
  • RED: indicates that, upon policy expiry, a score corresponding to poor driving has been achieved. This score corresponds to the worst price (the most expensive premium, typical of a high-risk driving style).
  • AMBER: indicates that, upon policy expiry, a score corresponding to good driving has been achieved. This score corresponds to an intermediate premium between the two above, although it remains competitive based on an adequate driving style.

When the customer places the order in the App, the premium corresponding to the green score (the lowest price) shown in the App is charged to the bank card (credit or debit), and the Subscription Agency is authorised to make subsequent charges for an amount equivalent to the difference between that initially charged amount and the highest price corresponding to the red score shown in the App.

Once the policy expires, and based on the driving style demonstrated during its term, if the resulting score is green, that amount is treated as definitively collected, releasing the remainder of the excess amount retained corresponding to the red score. However, if the score achieved is red or amber, an additional charge will be made to the bank card for the amount resulting from the difference between the premium corresponding to the actual final score (amber or red) and the premium initially charged corresponding to the green score.

In order to calculate the score for each journey, the following requirements must be met:

  • Have the App installed on the mobile phone
  • Have all App operating permissions enabled
  • Carry the mobile phone with the App installed and activated during all journeys made with the insured vehicle
  • Cover and record at least 5 km during the policy period so that the App can calculate the score.

If any of these requirements is not met, the App will not be able to calculate the score corresponding to the vehicle use, and the final price charged will be the one shown in red in the App, as it will not have been possible to demonstrate good driving to obtain a better price.

6. DRIVING DATA PROTECTION

Your driving data, which includes location, speed, mobile phone use while driving and information about your driving style, will be sent to the servers of our technology provider (Trak Global Solutions Holdings) in Canada.

This data is protected by the European GDPR and is processed in accordance with our Privacy Policy, which you can consult on our website https://daycover.es/en/privacy-policy/. This data will never be shared with third parties for commercial purposes and will only be provided to your insurer for the purpose of adjusting your premium at renewal, and to the analytics APIs of our technology provider, in the latter case in anonymised form and used solely for statistical purposes and app performance improvement.

7. MANDATORY DOCUMENTATION AND PHOTO INSPECTION

The photographs required at the time of purchase to verify the current condition of the vehicle, as well as the accuracy of the risk declaration provided by the insured at the time of purchase, are mandatory and binding. If they are not submitted, are illegible, show pre-existing damage to the vehicle, or if the information does not match what was declared, the insurance company reserves the right to reject any optional cover (own damage, wildlife collisions, theft, fire, glass and travel assistance). Mandatory cover (Compulsory and Voluntary Civil Liability and Driver Accident cover) will always be honoured.
